A woman in her thirties has been sentenced to imprisonment after falsely accusing her father, who had funded her overseas education, of rape because he declined to provide her with money.
As per information from the legal community disclosed on the 1st, the Criminal Division 1 of the Uijeongbu District Court's Namyangju Branch, led by Presiding Judge Choi Chi-bong, recently handed down a 10-month prison term to a woman, referred to as A, on charges of defamation, business obstruction, and insult.

A came under judicial scrutiny for posting defamatory content online 11 times between May and June of the previous year, under the heading "I am a victim of familial sexual violence. Please look at this," thereby tarnishing her father B’s reputation.
In these posts, she made unsubstantiated claims such as "I have been continuously sexually abused by my biological father since I was four," "My mother also endured domestic and sexual violence," "The matter was resolved with 30 million won in damages," and "A stringent punishment is warranted."
In this process, A went as far as revealing B’s full name and business details, which reportedly caused significant operational difficulties for B’s business.
A further alleged, through six additional posts, that B remarried a woman, C, with whom he had purportedly had an affair.

In February 2021, A initiated a lawsuit against B for damages related to sexual assault at the Incheon District Court but was unable to substantiate her claims with evidence of any illicit acts.
During the criminal proceedings, A maintained the veracity of her statements; however, the court dismissed her assertions, referencing the lawsuit’s outcome. The court highlighted the absence of any concrete evidence or situation to suggest that A was routinely sexually assaulted by B.
The court found it plausible to regard A’s allegations as unfounded, particularly considering that B had financially supported her education abroad and upon her return, and that her accusation of rape coincided with his refusal to fund her plan to open a cafe.

The court asserted, "Her dissemination of false information was driven by her dissatisfaction over being denied financial assistance. The victims’ reputations have suffered irreparable damage."
The court elucidated the rationale behind the sentencing, stating, "Taking into account the substantial risk of repeat offenses, as she continued similar postings even post-crime, and the victims’ strong call for severe punishment, these factors were collectively evaluated."
